TERMS AND CONDITIONS FOR BISJHINTUS PODCAST PLATFORM
We know it’s tempting to skip these Terms of Service, but it’s important for us to establish what you can expect from us as you use BISJHINTUS services, and what we expect from you.
1. INTRODUCTION
These Terms and Conditions ("Terms") govern the use of the BISJHINTUS PODCAST PLATFORM ("Platform") provided by M/s BISJHINTUS PRIVATE LIMITED ("we", "us", or "our"). By accessing and using the Platform, you ("User", "you", or "your") agree to be bound by these Terms. If you do not agree with these Terms, you may not be able to obtain the podcasting services through our podcast platform.
2. REGISTRATION AND ACCOUNT
To access and use the Podcast Platform at https://podcast.bisjhintus.com/login, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security.
3. AGE REQUIREMENTS
If you’re under the age of 13 years, you must have your parent or legal guardian’s permission to use our Podcast platform Account. Please ask your parents or legal guardian to read these terms with you.
If you’re a parent or legal guardian, and you allow your child to use the services, then these terms apply to you and you’re responsible for your child’s activity on the service.
4. USER CONDUCT
You agree to use the Podcast Platform only for lawful purposes and in accordance with these Terms. You agree not to:
3.1 Engage in any conduct that is harmful, harassing, defamatory, vulgar, or otherwise objectionable.
3.2 Use the PODCAST PLATFORM to promote or engage in any illegal activities.
3.3 Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
3.4 Upload, post, or otherwise transmit any content that you do not have the right to transmit under any law or contractual or fiduciary relationships.
3.5 Infringe upon the intellectual property rights of others.
4. INTELLECTUAL PROPERTY RIGHTS
4.1 All content on the Podcast Platform, including but not limited to text, graphics, logos, images, and software, is the property of BISJHINTUS PODCAST PLATFORM or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
4.2 You agree not to record, reproduce, duplicate, copy, sell, resell, or exploit any portion of the Podcast Platform without our express written consent.
5. USER CONTENT
By submitting, posting, or displaying content on or through the Podcast Platform, you grant us a worldwide, non-exclusive, royalty-free licence to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any content that you submit.
6. THIRD-PARTY LINKS
The Podcast Platform may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for the content, products, or services on or available from such websites or resources. You assume all risks arising from your use of any such websites or resources.
7. DISCLAIMER OF WARRANTIES
The Podcast Platform is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. LIMITATION OF LIABILITY
In no event shall BISJHINTUS PODCAST PLATFORM, its affiliates, or their respective officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of the Podcast Platform, whether based on warranty, contract, tort, or any other legal theory, whether or not we have been advised of the possibility of such damages.
9. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless BISJHINTUS PODCAST PLATFORM, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Podcast Platform or your violation of these Terms.
10. USER’S OBLIGATION
You may not allow anyone else to access PODCAST PLATFORM services via your log-in details. M/s BISJHINTUS PRIVATE LIMITED reserves the right to remove any delegate from the use of PODCAST PLATFORM services whose behaviour is deemed inappropriate by M/s BISJHINTUS PRIVATE LIMITED or its instructors. In these circumstances, M/s BISJHINTUS PRIVATE LIMITED will neither refund any fees nor reimburse any other costs.
11. WAIVER CLAUSE
Except as provided herein, the failure to exercise a right or to require the performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
12. NEWSLETTER SUBSCRIPTION
12.1 The podcast platform also provides a newsletter portal which the user can obtain by providing the mail ID in the newsletter subscription column.
12.2 This Newsletter is to stay connected with the platform and obtain exclusive updates regarding upcoming events and new plans and relevant workshops.
12.3 The mail ID of the user obtained by BISJHINTUS PODCAST PLATFORM is expressly used for above mentioned services in 12.2.
13. PODCASTING AND CONTENT USE RESTRICTIONS
The following are the users’ restrictions on podcast and blog content under the PODCAST PLATFORM BISJHINTUS. The user shall not:
13.1 Use the Podcast for any political or commercial purpose (including, without limitation, for purposes of advertising, soliciting funds, collecting product prices, and selling products);
13.2 Use any meta tags or any other "hidden text" utilizing any Trademarks
13.3 engage in any activities through or in connection with the Podcast that seek to attempt to or do harm any individuals or entities or are unlawful, offensive, obscene, lewd, lascivious, filthy, violent, threatening, bullying, harassing, or abusive, or that violate any right of any third party, or are otherwise objectionable to Company;
13.4 Interfere with or circumvent any security feature of the Podcast or any feature that restricts or enforces limitations on use of or access to the Podcast, the Content, or the User-Generated Content (defined below); (vii) harvest or otherwise collect or store any information (including personally identifiable information about other users of the Podcast, including email addresses, without the express consent of such users);
13.5 Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure;
13.6 Reverse engineer, decompile, disassemble, reverse assemble, or modify any Podcast source or object code or any software or other products, services, or processes accessible through any portion of the Podcast.
13.7 Otherwise violate any of these Terms and conditions or additional terms and policies of the company that are relevant.
14. TERMINATION
We reserve the right to terminate your access to and use of the Podcast Platform at any time, with or without cause, and with or without notice.
15. CHANGES TO TERMS
15.1 M/s BISJHINTUS PRIVATE LIMITED reserves the right to modify these Terms at any time as and when it is necessary.
15.2 These changes to the Terms and Conditions Agreement will be for valid reasons, such as improving our existing Podcast platform services or features by adding new functions to our PODCASTING SERVICES.
15.3 If we make any changes to these Terms, we will post the revised Terms on the BISJHINTUS PODCAST PLATFORM and update the “Last Updated” date at the top of these Terms. If you disagree with the revised Terms of M/s BISJHINTUS PRIVATE LIMITED you may terminate this Agreement with immediate effect.
15.4 If you do not terminate your agreement and continue to access BISJHINTUS PODCAST PLATFORM, it will constitute acceptance to the revised terms and conditions.
16. ENTIRE AGREEMENT AND SEVERABILITY
16.1 This Agreement is the entire agreement between you and BISJHINTUS PODCAST PLATFORM relating to Podcasting services that supersedes all prior or contemporaneous oral or written communications, proposals and representations with respect to Podcast platform or any other subject matter covered by these Terms & Conditions.
16.2 If any of the provisions of these Terms & Conditions is held to be void, invalid, unenforceable or illegal, that does not affect the validity or enforceability of other terms and conditions.
16.3 Every provision is separately enforceable by law if it is held legally valid.
17. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Podcast Platform shall be subject to the exclusive jurisdiction of the courts of Mangalore or Bangalore (Karnataka).
